What it is
A layered privacy notice offers a short decision aid while preserving navigable full detail. The summary is not a substitute for the underlying terms. Compression that retains only ordinary uses can omit exceptions that would change a choice—for example, treatment during disputes, cross-border processing, account closure, or processor changes. Quality depends on preserving decision-relevant meaning, not merely becoming shorter and more readable.
Why it happens
Summarization necessarily selects. Authors who know the system may demote internally rare limitations even when users decide from worst-case consequences, irreversibility, or a particular status. Keeping positive propositions in the first layer while burying qualifications creates a semantic gap: each sentence may be technically true while the overall impression is too broad. Without stable mappings, independently maintained layers also drift as terms change.
Studying it
Researchers can derive a proposition inventory from the full terms, have legal, privacy, and user representatives mark facts that could change a decision, and measure summary recall of those propositions and misleading inferences. Participants using a summary or layered notice can answer ordinary and exception scenarios, producing accuracy, search time, and confidence-calibration measures. Main-idea recall misses lost exceptions; confident errors are particularly diagnostic of false certainty.
Where it stops holding
Full terms are not inherently complete or understandable, and a link to them does not excuse a misleading summary. Not every procedural qualification belongs in the first layer, but exceptions changing data subjects, recipients, duration, rights, or material consequences should be discoverable next to the relevant proposition. Jurisdiction-specific terms require corresponding summaries rather than one globally uniform but inaccurate version.
Applying it
- Extract proposition–qualification–exception triples and link every first-layer proposition directly to its qualifications under the same topic.
- Prioritize by risk and decision relevance, not occurrence frequency or marketing readability alone.
- Version summary and terms in one change process, blocking release when a modified proposition lacks an updated summary mapping.
- Test normal and boundary scenarios answerable from the first layer or one expansion; when omission reverses the expected judgment, promote the exception and retest.
